Coupled with a facility's safety training, this program will meet the requirements for a 3-year certification of training.

Webinar: Get to Know EPA's New Regulatory Program, Clean Water Act Hazardous Substance Facility Response Plans

On March 28th the Environmental Protection Agency (EPA) published the rule “Clean Water Act Hazardous Substance Facility Response Plans.” This rule establishes a new regulatory program for facilities that are located near a navigable waterway, store at least 1,000 times the reportable quantity of a Clean Water Act hazardous substance, and meet a substantial harm criteria. The rule’s author, Rebecca Broussard, will discuss the program’s requirements and steps facilities may want to take to ensure compliance.

Webinar: 2024 Chemical Inventory Management: From Blind Spots to Best Practices

Attendees will come away with key insights to help those involved with chemical distribution navigate the continually evolving challenges of chemical inventory management. The goal is to find the ideal balance between sales (and service levels), working capital, and profitability.

This webinar is designed to help attendees navigate challenges that are unique to the chemical industry (and hard to navigate in traditional ERPs and software packages:

  1. Factoring product expirations into best-practice chemical inventory management.
  2. Optimizing inventory of multi-sourced chemicals that don’t get tracked at a supplier level.

Webinar: OSHA's New Worker Walkaround Rule, What to Expect and How to Prepare

On May 31st the Occupational Safety and Health Administration’s (OSHA) Worker Walkaround final rule went into effect. This rule greatly expands which third-party individuals can serve as employee representatives during an OSHA inspection. Under this rule, 3rd-party representatives are permitted to enter facilities to accompany an inspection so long as they are considered “reasonably necessary” to assist in the inspection. This can potentially include union representatives in non-union workplaces, disgruntled ex-employees, activists, and more. In this webinar, Marc Freedman of the U.S. Chamber of Commerce will delve into the details of this rule and what it means for employers. He will then explain steps employers can take to prepare for the greater range of potential third-party employee representatives who may attempt to enter their facility during an OSHA inspection.

ACD Online Training – Chemistry 101

Have you ever struggled to understand those crazy chemical names, or what a class of chemicals can do in an emergency? This course is for you!

Chemistry 101 is the chemistry class for the non-chemist. This training will review the basics of chemistry and how these basics apply to the chemicals ACD members work with every day. Examples from the chemical industry will be used to explain the hazards, characteristics, and common reactions that are associated with acids, bases, flammables, oxidizers, toxics, and organics. The goal of Chemistry 101 is for members who participate to be able to identify and characterize chemicals into broad categories; determine the possible general hazards and reactions associated with handling, storage and transportation; and identify different ways to cleanup small spills and leaks.

Session IBasics of Chemistry – this session will delve into the very basics of chemistry, as needed in the chemical distribution industry. We will look at the different groups of chemicals (acids, bases, etc.), the hazards generally attributed to each group, and how to typically identify different groups of chemicals by looking at the name. In addition, we will take an imaginary walk through a warehouse and use the information gathered to look at chemical compatibility, a significant concern of the OSHA/EPA/DHS Joint Working Group on Warehouse Safety.

Session II: Reaction Chemistry – this session will take the information from Session I and dig a little deeper. We will look at what happens when a release occurs, what to worry about, and where to find important information. In addition to what happens when a release occurs, we will also look into basic reactions, selecting the correct type of cleanup materials and personal protective equipment, and what to do with the materials.

While long range forecasts are notoriously unreliable, the team at Tropical Storm Risk are anticipating activity 30% above the near norm, and 50% above the long-term norms this hurricane season. The deadline to file Toxic Release Inventory (TRI) reports to the U.S. Environmental Protection Agency (EPA) for calendar year 2023 releases is approaching quickly.

Chemical distributors face unique challenges in TRI reporting, making it easy to overreport or underreport annual releases. Both situations should be avoided. Overreporting can make your facility appear in the eyes of the EPA and your community to be a bigger polluter than it is. Underreporting or failure to report can result in substantial EPA penalties.

In this interactive training on the rules governing the transportation of hazardous materials, participants will receive general awareness, function-specific, and general security awareness training for shippers, as required in 49 CFR 172.700. Coupled with a facility's safety training, this program will meet the requirements for a 3-year certification of training.

Every four years, chemical manufacturers and importers are required to provide EPA with information on the production and use of chemicals in U.S. commerce. The information gathering process is often not straightforward and missteps in reporting can invite enforcement and commercial liability. The 2024 CDR submission period will be from June 1, 2024 to September 30, 2024, during which manufacturers (including importers) must report if they meet certain volume thresholds at any single site for each calendar year from 2020 – 2023. CDR data is published and supports EPA’s information needs for prioritization, risk evaluation and risk management under the Toxic Substances Control Act (TSCA).

In this webinar Bergeson & Campbell, P.C.’s Richard E. Engler, Ph.D., Director of Chemistry, will present best practices to prepare for this reporting cycle. This webinar will offer decision making training on identification of relevant reporting requirements and exemptions for companies and chemical substances.     OSHA's Hazard Communication Standard (HAZCOM) is based on the concept that employees have both a need and a right to know the hazards and identities of the chemicals they are exposed to while working.     This HAZCOM training will take place in two parts:

    IRS Issues Proposed Superfund Chemical Excise Tax Regulations – What Now, What is Next?

    Now that there are proposed regulations for the superfund chemical excise tax, tax attorney Douglas Charnas of McGlinchey Stafford and chemist Dr. Richard Engler of Bergeson & Campbell, P.C. will provide an update on the tax, share their thoughts on the proposed rule, and highlight any outstanding questions.

    For well over a year, NACD has been seeking more clarity from the Internal Revenue Service (IRS) on implementation of the Superfund Chemical Excise Tax, which took effect July 1, 2022. NACD has met with the IRS twice, sent four detailed letters to the Agency, and initiated numerous contacts from Capitol Hill requesting additional guidance and penalty relief.

    In late March, IRS issued long-awaited proposed Superfund tax regulations. The proposed rule addresses many of the questions NACD has raised. These included new and/or expanded definitions, with examples, for “sale”, “use”, “importer”, and “manufacturer”. The IRS has also requested input on the most appropriate ways to assign Chemical Abstract Service Registry Numbers or Harmonized Tariff Schedule Codes to products subject to the tax. Comments on the proposed rule are due May 30. NACD will be submitting comments.

      Reinstatement of Superfund Tax on Petroleum Products – Impact on Chemical Distributors

      The Inflation Reduction Act of 2022 reinstated the Hazardous Substance Superfund Financing Tax Rate on Crude Oil and Petroleum Products, effective January 1, 2023. This is in addition to the reinstated Superfund chemical excise tax that took effect on July 1, 2022. Certain liquid taxable substances subject to the chemical excise tax may also be petroleum products. When a chemical product is both a taxable substance and a petroleum product, it is taxed as a petroleum product, with the taxes due when entered into the United States. This is likely to have an impact on NACD members and cause even more confusion.

      Superfund Tax Reinstatement – What Does This Mean for Chemical Manufacturers/Importers and Distributors?

      Exporting Chemicals 101

      Exporting chemical products from the United States increasingly is challenging. Such exports are subject to regulation under the Toxic Substances Control Act (TSCA) and the program is administered by the U.S. Environmental Protection Agency and the U.S. Customs and Border Protection. TSCA Section 12(b) requires chemical exporters to notify EPA, in writing, if they are exporting, or intending to export, certain chemical substances or mixtures that are subject to certain TSCA rules or orders.

      This webinar explores the TSCA export rules, and provides useful hands-on tips on how best
      to comply with the law and stay below the radar. Specifically, we discussed:

      A Biden Administration OSHA Outlook

      With a new administration in Washington, including a recently nominated head of the U.S Occupational Safety and Health Administration (OSHA), big changes are likely coming for workplace safety regulations and enforcement. While OSHA kept a relatively low profile during the Trump Administration, the agency has been extremely active during the first weeks of the Biden Administration.       The Duke Management Program (DMP) translates the science of management into practical insights and actionable items. By using a diagnosis-and-treatment approach, you'll learn how to identify the causes and solutions to prevent team inefficiencies and underperformance. By working through different management scenarios you’ll learn to:

      • Avoid common decision traps so you can make good decisions and create effective plans
      • Determine what motivates—and what demotivates—each employee
      • Convey employee feedback that is fair and accurate
      • Coach for skill and career development
      • Use your power-personal and positional-to gain additional resources
      • Manage your team through skilled negotiation and networking
      • Create effective structures, procedures, and cultures

      Learning Outcomes

      • Create a Management Action Plan (MAP) specific to your team, using your Six Effects of Management survey.
      • Simulate intra-organizational negotiation methods to sustain employee motivation.

      • Map and create a strategy for your network.
      • Use a “Motivation Analyzer” to find weak links between incentives and performance.
      • Develop a timeline to improve and measure your managerial effectiveness.
      • Practice a “Difficult Feedback” exercise.
      • Discuss how to balance and apply outcomes of your MAP.

      Purdue Certificate in Innovative Distribution

      At the conclusion of the program, all attendees will receive, via mail, an official Letter of Completion issued by the Purdue University awarding 30 hours (3 CEUs – Continuing Education Units) for satisfactory completion of this four-day UID program. These CEUs may be applied toward your Professional Certificate in Innovative Distribution. As an Innovative Distribution Professional, the Purdue University Certificate recognizes your achievements and commitment to continuing education.       The Duke Executive Education's Duke Leadership Program (DLP) presented by NACD is based on the principle that every leader has an individual style. The goal of the program is to help you systematize your intuitive leadership skills in an intense and supportive environment, learning to capitalize on your strengths while overcoming leadership challenges. Great leaders are continually learning. This program is ideal for anyone with current or anticipated leadership responsibilities, ranging from high-level executives and managers to people expecting to take on leadership roles, to those who are not in management positions but are expected to lead and influence others in the course of their work.

      • The program teaches six dimensions of leadership and uses a personalized method for helping you develop your competencies in each of the six areas.
      • Central to the course is a 360-degree assessment tool to be completed in advance of the program by your colleagues. Each assessment is interpreted by a professional coach who will work individually with you to analyze the results and apply leadership principles to the feedback.
      • You will work with a coach to complete a Personal Development Plan (PDP) to help you become the type of leader you strive to be. The PDP will serve as a roadmap for addressing new leadership challenges after completion of the course. In addition to working with course instructors on these plans, you will be divided into small working groups to provide each other feedback.

      • Become more intentional and strategic in leadership as opposed to relying on intuition
      • Create and project your vision, values, and expertise
      • Demonstrate understanding of and concern for others
