On March 28th the Environmental Protection Agency (EPA) published the rule “Clean Water Act Hazardous Substance Facility Response Plans.” This rule establishes a new regulatory program for facilities that are located near a navigable waterway, store at least 1,000 times the reportable quantity of a Clean Water Act hazardous substance, and meet a substantial harm criteria. The rule’s author, Rebecca Broussard, will discuss the program’s requirements and steps facilities may want to take to ensure compliance.
