Helping You Stay Competitive and Compliant

Navigating the complexities of regulatory compliance can be a proverbial minefield for chemical distributors – and it’s particularly tough when so many new requirements and policies are constantly being introduced.

To help make sense of the raft of rules and regulations, NACD members can seek advice and guidance from law firm Bergeson & Campbell, P.C. – an NACD Strategic Partner since 2011.

“It's a very busy time with much more legislative oversight that will have a significant bearing on NACD members’ operations. Navigating that very congested space can be extremely tricky,” says Bergeson & Campbell, P.C. Managing Partner Lynn Bergeson.

“We offer NACD member companies and their employees counselling services on a wide variety of matters involving the chemical products that they distribute,” she adds. “We focus on domestic and international chemical regulatory governance systems, answering questions on how these laws – and the regulations implementing those laws – affect their operations.”

The firm’s unique blend of legal, government affairs, and scientific expertise offers support in an ever-changing regulatory landscape, including the recently reinstated Superfund tax; the Toxic Substances Control Act (TSCA); a compliance issue following a visit from the U.S. Environmental Protection Agency; or pretty much any type of federal or state regulatory requirements applicable to chemical distributors.

“We try very much to have an open door to provide answers to any questions a company may have,” she says. “We live in a very fast-moving world. If a question comes up, often you need a response fairly immediately. We try to be very accessible because sometimes things just can't wait.”

Headquartered in Washington, DC, the business has 55 employees globally and is also affiliated with global consulting firm The Acta Group LLC., which serves North America, Canada, and South and Central America and also has offices in Brussels, Belgium; Manchester, UK; and Beijing, China.

“We have a lot of people who have their ears to the ground in a lot of areas,” she says. “We carry out trends analysis, look at legacy issues, and deal with future, past, and present regulation.”

Bergeson & Campbell is a regular speaker at NACD events and webinars, sharing the latest regulatory developments and highlighting their impact on member companies. The business has a close relationship with the association, and Bergeson regularly liaises with NACD’s policy team to share information and updates to ensure NACD members’ interests are vigorously advocated.

All NACD members are eligible for discounted consulting rates, as well as a free half-hour consultation each quarter.

Bergeson & Campbell offers many resources to keep companies up to date with the latest changes, including five dedicated blogs on bio, nano, TSCA, FIFRA, and REACH, as well as its All things Chemical podcast series – covering global transport and distribution and the use of industrial chemicals, agrochemicals, and biocides.

Live, in-person training at a company’s site is also available alongside online training programs covering TSCA, the Global Harmonized System of Classification and Labelling of Chemicals, and other pressing issues.
