NACD Applauds Resolution on EPA RMP Rule

Today, NACD President Eric R. Byer issued the following statement on the introduction of a Joint Resolution offered by Congressman Markwayne Mullin (R-OK) that would provide for congressional disapproval of the U.S. Environmental Protection Agency’s (EPA) Risk Management Program (RMP) rule under the Congressional Review Act:

“NACD welcomes the Joint Resolution offered by Congressman Mullin on the EPA’s Risk Management Program rule. The association has repeatedly stated throughout the rulemaking process that the RMP rule imposes significant new costs on industry without identifying or quantifying the safety benefits to be achieved through new requirements.

“For companies that handle hazardous materials — which includes a significant number of chemical distributors that already participate in environmental, health, safety, and security programs — the new rule will require costly third-party audits, extensive investigation requirements for ‘near misses,’ and a requirement to conduct a complex safer technology alternatives analysis that EPA previously rejected due to a lack of expected benefits. The Department of Homeland Security has also repeatedly raised concerns about increased security risks given the rule’s public information disclosure requirements. 

“I want to thank Congressman Mullin for his leadership on this important issue and encourage all Members of the U.S. House of Representatives to co-sponsor his Joint Resolution so NACD member companies and others in the chemical industry do not face undue regulatory burdens that will provide little, if any, safety improvements.”
