    The chemical distribution industry is subject to an overwhelming number of federal regulations from multiple agencies, including the Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA), Department of Transportation (DOT), Food and Drug Administration (FDA), Department of Homeland Security (DHS), and others. Nefarious actors sometimes use seemingly legitimate means to acquire dangerous chemicals, such as by posing as potential customers or attempting a fraudulent purchase. In this session, CISA chemical security experts will provide an overview of the ever-evolving threat landscape and share best practices in product stewardship and cyber hygiene. Participants will also learn about the range of no-cost services and tools CISA provides to help manufacturers, distributors, retailers, and consumers secure dangerous chemicals. General Session: The Case That Launched a Thousand 28(j)s: The Far-Reaching Consequences of the Supreme Court’s Recent Landmark Decision Overruling Chevron Deference
Kian Hudson, Barnes & Thornburg, LLP

The regulatory climate for the business community, including chemical distribution, continues to be challenging, to say the least. The last year of each Presidential Administration, the current one being a prime example, brings an onslaught of changes and new rules. For the last several decades, businesses seeking to challenge these regulations faced a major hurdle—Chevron deference, which required courts to defer to agencies’ interpretations of ambiguous statutory provisions. In Loper Bright v. Raimondo, however, the Supreme Court recently overruled Chevron deference—and thereby effected a dramatic change in federal administrative law. During this special and timely closing session, experienced appellate lawyer Kian Hudson will share his insights on the Court’s decision, including why the Court overruled Chevron, how its decision is likely to affect regulatory litigation, how the decision will interact with other recent administrative-law decisions, and what other consequences the decision could have for the regulated community.Download slides here.
