- Every four years, chemical manufacturers and importers are required to provide EPA with information on the production and use of chemicals in U.S. commerce. The information gathering process is often not straightforward and missteps in reporting can invite enforcement and commercial liability. The 2024 CDR submission period will be from June 1, 2024 to September 30, 2024, during which manufacturers (including importers) must report if they meet certain volume thresholds at any single site for each calendar year from 2020 ? 2023. CDR data is published and supports EPA's information needs for prioritization, risk evaluation and risk management under the Toxic Substances Control Act (TSCA).
In this webinar Bergeson & Campbell, P.C.'s Richard E. Engler, Ph.D., Director of Chemistry, will present best practices to prepare for this reporting cycle. This webinar will offer decision making training on identification of relevant reporting requirements and exemptions for companies and chemical substances. - Webinar Slides: Reinstatement of Superfund Tax on Petroleum Products ? Impact on Chemical Distributors
- The Inflation Reduction Act of 2022 reinstated the Hazardous Substance Superfund Financing Tax Rate on Crude Oil and Petroleum Products, effective January 1, 2023. This is in addition to the reinstated Superfund chemical excise tax that took effect on July 1, 2022. Certain liquid taxable substances subject to the chemical excise tax may also be petroleum products. When a chemical product is both a taxable substance and a petroleum product, it is taxed as a petroleum product, with the taxes due when entered into the United States. This is likely to have an impact on NACD members and cause even more confusion.

- The newly enacted Infrastructure Investment and Jobs Act ("Infrastructure Act") has revived and doubled the long-expired "Superfund" excise taxes on selected chemicals. Under the Infrastructure Act, beginning July 1, 2022, manufacturers, producers and importers will be responsible for an excise tax on a universe of 42 chemicals, or on substances made from them, which will be directed to the Hazardous Substance Superfund Trust Fund. Experts from the law firm of Baker Botts reviewed the details of the taxes, discussed how they will be implemented, and answered questions.

Such exports are subject to regulation under the Toxic Substances Control Act (TSCA) and the program is administered by the U.S. Environmental Protection Agency and the U.S. Customs and Border Protection. TSCA Section 12(b) requires chemical exporters to notify EPA, in writing, if they are exporting, or intending to export, certain chemical substances or mixtures that are subject to certain TSCA rules or orders.
